Note from
Timothy E. Peterman approved "Sons of the American Revolution" application
for recognition as a descendant of John Hathaway says “...assisted in establishing
American Independence while acting in the capacity of First Lieutenant., Capt.
James Scott’s Fauquier Independent Company, 1777; Captain, Fauquier Co., VA
Militia, 1779-81.”
(Following
appears to be extracted from “Hathaways of America”, compiled by Elizabeth
Starr Versailles. Houston Clayton Library has a copy. The house “Hatherage”
still exists, pictures available at http://www.enonhall.com/html/captjohn.html
“The will of
John Hathaway is written in clear handwriting with perfect spelling. He was
stout, handsome, very active, well-proportioned, with beautiful shining black
hair. Undaunted resolution, friend of American Revolution, commanded a militia
company which served in Pennsylvania and New York during the war; called Capt.
John. In 1772, he moved about 12-14 miles above Warrenton, built Hatherage, a
long rather narrow stone house, 2-3 miles northeast of Marshall, set back from
the road leading from Warrenton to Middleburg, via The Plains and Zulle. When
Hatherage was sold in 1837 the following reservation was made: "It is
expressly understood between the foregoing parties Hathaway and Kincheloe that
the family Graveyard on the farm herein conveyed in reserved and excepted and
shall be forever subject to the use and direction of the said Hathaway and
heirs including the ground now enclosed for that purpose and not to exceed one
fourth of an acre. In testimony whereof the parties have here unto set their
hands and seals the day and year above written." Signed by Brandt
Kincheloe and H. S. Hathaway, rec. Deed Book 37, page 377, Fauquier Co., Va. It
is presumed that John and Sarah and two of their children are buried there.

Following is the text of the last
will and testament of Capt. John Hathaway, obtained from the Book of
Wills #2, Page 10A of Fauquier County, VA:
In name of
God Amen!
I, John
Hathaway, of the county of Fauquier and State of Virginia, being weak and sick
in body at present but of sound mind and memory, thanks to almighty God, do
make this my last will and testament in manner and form following imprimus. My
will and desire is that all my just debts be first paid.
Item 1 - As I am
owing my daughter Elizabeth Hathaway a certain sum of money by a bond of mine,
given to my brother James Hathaway which he assigned to her to discharge said
bond. I do give and bequeath unto my said daughter Elizabeth one negro girl
named Hagare to her and her heirs forever.
Item 2 - I give
and bequeath to my loving wife, Sarah Hathaway, the tract of land where I now
live with all the rest of my negroes, horses, cattle, and household furniture
during her natural life.
Item 3 - It is my
will and desire that if my wife Sarah Hathaway should die before my sons, Henry
Lawson Hathaway, Francis Hathaway and Sarrepta Hathaway receive their
education, that they shall be educated. Lawson at least three years more than
he has already received, Francis four years more and Sarrepta two years more,
which shall be done at the expense of my estate.
Item 4

After the decease of my wife it is my will and desire that all the land whereon
I now live with all the negroes, horses, cattle and household furniture which I
gave to my wife Sarah Hathaway as above be sold and equally divided between all
my children viz; Judy Kemper, Sarah Bartlett, Elizabeth, John, Nancy, Susan,
Molly, Dolly, Peggy, Lawson, Sarrepta and Francis, except to my two daughters
Judy Kemper and Sarah Bartlett, who are to have each twelve pounds less than
the rest of my children before mentioned.
Item 5 - I give
and bequeathe to my son, John Hathaway, the land which Simon Kenton was to
locate for me, which is 1100 acres lying near the Big Sand River to him and his
heirs and assigns forever.
Item 6 - I give
and bequeathe to my two sons Lawson Hathaway and Francis Hathaway the tract of
land I bought of Powers and Davison lying on the Tyger River in Harrison County
containing 561 acres to their heirs and assigns forever.
Item 7 - My will
and desire is that if my son John Hathaway should not get the land which I gave
to him above mentioned that then he shall have an equal part of the tract of
land I willed to my sons Lawson and Francis Hathaway.
Item 8 - I do
nominate and appoint my loving wife Sarah Hathaway, executrix and my son John
Hathaway, executor of this my last will and testament. Lastly do I hereby
revoke and disannull all other wills and testaments made by me heretofore made
and do acknowledge this only to be my last will and testament. In where I have
hereunto set my hand and seal: This 4/13, 1786.

Gwathey's
Register of Virginians in the Revolution states he resigned as Major in May
1783, but lists him as Lt. in Capt. James Scott's Co., Va. Militia, in 1777.
His S.A.R. record, Ohio, called him Capt. of Militia Company in Continental
Service from 25 Oct. 1779 to 26 May 1783, continued in Civil Service, holding
office of Associate Justice, Court of Common Pleas, Fauquier County. The John
Marshall Chapter, D. A. R., Registrar in 1943, stated that Ann, Dorothy,
Margaret, Sarepta, and John, all children of Capt. John Hathaway, came to Mason
Co., Ky.
John
Hathaway, 1779, was appointed captain by the Fauquier county court and served
until peace was declared.
