Misc. Notes

Original spelling apparently "PRESLY".

William was consistently known as "Gentleman".

William's will dated 15 August 1650 and proved 20 January 1657 in Northumberland County, Virginia. A very brief abstract of the will, dated 15 August 1650, and proved 20 January 1656/1657, indicated he "to be buried beside deceased wife; son William to be guardian of Peter. Son Peter executor, he under 21 years.

William came to Virginia by 1647.

William was a Justice in Northumberland County, Virginia, on 24 August 1650. William received 450 acres for importing himself and his wife, Jane, Thomas Underhill, Joseph Beaven, William Bancroft, John Lane, William Boles, Roger Lane, and Hannah Newman. (Hannah Newman is believed by many to be the sister of his wife, Jane.)

The name died out in America in the 4th generation when the last male of the line died without an heir, but the name Presly - later changed to Presley - was used for generations by descendants of the family.

William PRESLY, Gentleman, the immigrant was the second Burgess from Northumberland and represented this county in the Assembly Nov 1647. Nothing is certainly know of his ancestry. He was recognized as a man of ability and high character as our scant biographical material shows.

William PRESLY may have come to "Chicakawane alias Northumberland" with Col. John MOTTROM. His offical life is traced in these court records:

1647 Burgess

1651 Wm. Presly and John TRUSSELL, burgess

1652 His name appears in first list of Justices

1654 sworn High Sheriff

1655 Mr. Wm. PRELSY one of the collectors of the minister's salary--to pay Mr. Hugh LEE amount due him of same

1655 Mr. Wm. PRESLY, Robert NEWMAN and John HULL, church wardens, Chicacone Quarter.

A patent for land was granted Mr. Wm. PRESLY, by Gov. BERKELEY, 11 Feb 1650. He was also granted land for the transportation of his wife, Jane PRESLY and Hannah NEWMAN (probably her sister) into the colony.

Mr. Robert NEWMAN in his will, d 2 Jan 1655, names Wm PRESLY ( son of Wm PRESLY) his loving nephew and makes him executor of his will. Thus Jane PRESLY, wife of Mr. PRESLY, Sr., was probably the sister of Robert NEWMAN.

Mr. Wm. PRELSY died abt Dec 1655. His will was dated 15 Aug 1650 and proved 20 Jan 1656. To his son William PRESLY, 340 acres, and the right for 200 more. Also a cow that had formerly belonged to John HAYNIE.

To his grandchild, Wm. PRESLY, son of William…

To son Peter PRESLY the rest of estate and to be executor.

One of the witnesses Thos. WILSFORD, on 20 Jan 1657, made oath that "Mr. Wm. PRESLY, Sr., being in perfect mind and memory gave instructions to theis deponent to draw up into form his last will and Testament and this depon't did and this is the very same will--all of this depon'ts owne handwriting--and this depon[t further sayeth that he was the said Testator sign seale and heard him acknowledge same to be his last will and testament."

As there is no mention of his wife, Jane PRESLY, she had probably died before 1650.

Issue named in his will:

William

Peter

William, his grandchild, son of William

Misc. Notes

Peter came to Virginia from England with his parents. Peter was executor of his father's estate 15 August 1650 and listed as a minor. Colonial law dictated that a male could serve as an executor at age fourteen with supervision. His birthdate can therefore be calculated as 1629 to 1636.

Peter was Justice of Northumberland County, Virginia, in 1660, 1685, 1686 and was Burgess in 1661.

Elizabeth and Peter were married between 20 February and 20 June 1664 as reflected in Northumberland County records.

Peter's will was proved 19 April 1693 in Northumberland County, Virginia. His nephew, Peter Presley Jr., was executor.

Called "Sr." to distinguish him from a nephew who is designated "Jr." He was still a minor when his father died in 1655 but he signed an oath of allegiance to the Commonwealth of England on 13 Apr 1652.
