Defendant Claims Wrongful Arrest Lead to Charge

A man facing charges of violating federal probation in United States District Court here today claimed he was falsely arrested in North Wilkesboro and charged with public drunkenness by police.

Granville Monroe Coffey of Cycle, serving a five-year probation on two counts of violation of Internal Revenue laws relating to distilled spirits, denied that he was drunk at the time of his arrest. The federal charges of probation violation stem from his conviction for public drunkenness.

Testimony in the case was to begin shortly before noon today. Coffey's allegations came to light as Judge Edwin M. Stanley explained the case to a court-appointed lawyer named today to defend Coffey.

According to Judge Stanley's resume of the case, the defendant claimed he was "arrested without rhyme or reason" and was then told by a bondsman "everything would be fixed up" if he gave officers "a few dollars." The bondsman, Coffey maintained, took his money and a plea of guilty in the drunk case was entered without his knowledge or authorization.

Subpoenaed to appear in federal court to testify in the case today were the North Wilkesboro police officers who arrested Coffey, the bondsman involved and the court records of the disposition of the drunk charge against Coffey.

The defendants' probation was part of a sentence imposed on him by Judge Stanely [sic] Jan. 28, 1960, in Wilkesboro division of federal court. At the time Coffey received a 15-month active sentence on two county of non-taxpaid whisky charges. He was also handed a two-year sentence on two other counts of the same offense, the term suspended provided he would abide by a five year probationary stretch.

Joseph Benjamin Davies of Rockingham was convicted of probation violation this morning and was handed an 18 months active sentence by Judge Stanley.

He had been convicted last March of an unregistered distillery and received a 20-month sentence, 30 days of it to be served in jail and the remainder suspended, with Davies placed on probation.

In a later article dated Jan. 12, 1963, it was reported that Granville, 49, had been found guilty of violating probation and was given a 23-month prison sentence. The item reports that the judge did not believe his contention as claimed but was a scheme to avoid being found in violation of his probation. He had been granted parole in a similar case in 1960.
