Coffey were married on 28 January 1836 in Nelson Co., VA.1258,1259 They1258,1259 appeared in the census on 21 August 1850 in Nelson Co., VA.1260 They1260 appeared in the census on 25 June 1860 in Nelson Co., VA.1261 Benjamin and Candis1261 appeared in the census on 1 July 1870 in Nelson Co., VA.1262 They1262 appeared in the census on 2 June 1880 in Massies Mill, Nelson Co, VA.1263 Deed: Benjamin Coffey & Wife To William Massie, 1842 This Indenture made this 28th day of October Eighteen hundred and forty two between Benjamin Coffey and Candis Coffey his wife (formerly Candis Coffey) of Nelson County of the one part, and William Massie of said County of the other part Witnesseth, That for and in consideration of the sum of two hundred and fifty dollars to them the said Benjamin Coffey and Candis Coffey, in hand paid by the said Wm. Massie before the ensealing and delivery of these presents, the receipt of which is hereby acknowledged: They the said Benjamin Coffey and Candis Coffey, have bargained and sold, and do by these presents bargain, sell, alien, enfeoff, release, and confirm, unto the said Wm. Massie and his heirs forever in fee simple their entire interest for the present, and in remainder in the following tract of Land, lying and being on Tye River in Nelson County, and containing by survey (made in March 1835) one hundred and sixty four acres, be the same more or less- It being the said Candis Coffeys (formerly Candis Coffey) interest, in that part of Peter C. Jacob's Land, which he the said Peter C. Jacobs devised by his last Will and Testament, to George Williams and John M. Martin, in trust for the benefit of Nancy Coffey and her three children, Candis Coffey, Sophia W. Coffey and Ann Coffey, and at the death of Nancy Coffey, to be divided equally between her children, as above enumerated & c & c And the same land was allotted (by commissioners appointed by the Court) to the said Devisees on the 28th of September 1835, at which time said commissioners, also allotted to David Jacobs, Peter J. Hill and Peter C. Clarkson, their portion of his entire tract, which he the said Peter C. Jacobs devised to them & c & c as may be more fully seen by reference to the report of said commissioners returned to the Court of Nelson County and filed in the Clerks Office thereof. And the said land adjoining the lands of Permelia Jacobs, Susanna Hill and the said William Massie, together with all the appertenances thereto in any wise belonging, yearly and other rents, profits and emoluments of every kind, from the date thereof, to have and to hold the interest aforesaid, in the land aforesaid, with all its appertenances, to the only proper use and behoof of him the said William Massie, and heirs forever in fee simple, and the said Benjamin Coffey and Candis Coffey for themselves, their Heirs, Executors and Administrators, do covenant and agree to and with the said Wm. Massie, and his heirs, that they will warrant and forever defend their entire interest, both the present and the remainder, in the land aforesaid, and all rents, profits, and emoluments, that may hereafter accrue therefrom, with all its appertenances to the said William Massie and his heirs forever in fee simple, free from the claim, title, challenge or demand of them the said Benjamin Coffey and Candis Coffey his wife and of all and every person or persons whatsoever. In testimony whereof the said Benjamin Coffey and Candis Coffey his wife, do hereunto set their hands and seals the day and year first above written. Benjamin Coffey (SEAL) Nelson County to wit: We Edmund F. Coffey and Robert H. Anderson, Justices of the Peace in the County aforesaid, do hereby certify that Benjamin Coffey a party to a certain deed bearing date on the 28th of October 1842 and hereunto annexed, personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed, and desired us to certify the said acknowledgment to the Clerk of the County Court of Nelson, in order that the said deed may be recorded. Given under our hands and seals this 29th day of October 1842. Edmund F. Coffey (SEAL) Nelson County to wit: We Edmund F. Coffey and Robert H. Anderson Justices of the Peace in the County aforesaid do hereby certify that Candis Coffey the wife of Benjamin Coffey a party to a certain deed bearing date the 28th of October 1842, and hereunto annexed, personally appeared before us in our County aforesaid, and being examined by us privately and apart from her husband, and having the Deed aforesaid fully explained to her, she the said Candis Coffey acknowledged the same to be her act and deed and declared that she had willingly signed, sealed, and delivered the same, and that she wished not to retract it. Given under our hands and seals this 29th day of October 1842. Edmund F. Coffey (SEAL) Teste Sp: Garland Ck ------------------------------------------------------------ Benjamin and Candis were forced to sell part of her inheritance received from Peter Jacobs. ------------------------------------------------------------ This Deed made the 26th day of October 1850 between Benjamin Coffey of the one part and Jacob Warrick of the other part: Witnesseth: that the said Benjamin Coffey doth grant unto the said Jacob Warrick the following property: one bay horse, one red cow, one pied cow and red calf all his household and kitchen furniture and one third part of all the slaves willed to Nancy Coffey during her life (by Peter Jacobs decd. as per will of record in Clerk's Office of Nelson County) with remainder over to her three children, Sophia, Ann and Candy Coffey to Wit. Jack, Isbell, Ancell, Sally, Harriet, Washington, Milly, Eliza, Rose and infant girl daughter of Sally & all the future increase of the females. In trust to secure the payment of a bond executed to Tho. P. Massie of the date of these presents for the sum of one hundred and twenty dollars and 63 cents. Now this deed Witnesseth that if the said Benjn. Coffey pays or causes to be paid unto the said Thomas J. Massie his heirs or assigns the debt (with full interest) above mentioned on or before the 26th day of October one thousand eight hundred and fifty two, then this deed shall become null & void otherwise the said Jacob Warrick shall on the premises on the said 26th day of October 1852 after having given 30 days notice in the public places of the neighbourhood proceed to sell for cash or on such credit as he may deem best, the said property whether in possession or remainder or so much of it as may be necessary to pay the debt aforesaid and after paying said Massie his debt to pay the balance if any to the said Benjamin Coffey or his assigns. In witness whereof the parties have hereunto set their hands and affixed their seals. Coffey whose name is signed to the within deed of trust bearing date of the 26th day of October 1850, has acknowledged the same before me in my County aforesaid.
